The Supreme Court today, declaring a historic decision, said that triple talaq is ‘unacceptable’, ‘illegal’ and ‘unconstitutional’. In the verdict opinion of 3:2 of the apex court said, triple talaq is against the fundamental principle of the Quran. Prime Minister Narendra Modi said that Supreme Court judgement to ban the practice of triple talaq is historic, it will grant equality to muslim women.

The Constitutional Bench of five judges said in their 395-page order, “Due to the various votes recorded through the majority of 3:2, -Talaq-e-Biddat and triple talaq will be treated as unconstitutional.” Chief Justice While JS Kher and Justice S. Abdul Nazir were in favor of asking for the government to come out with a new law in this regard for six months on the practice of divorce, Justice Kurian Joseph, Justice R. F. Nariman and Justice UU Lalit said that this practice violates Constitution.

In the majority verdict, it was said that every practice including three divorces is unacceptable, which is against the fundamental principle of the Quran.

Three judges also said that the practice of divorcing through three divorces is obviously voluntary. It is a violation of the Constitution and it should be removed.

A minority verdict of Chief Justice Kher and Justice Nazir talked about a six-month ban on the practice of divorce. Simultaneously, political parties were asked to help the Center to bring a law bypassing their differences.

Judges of the minority judgment said that if the center does not come under the law within six months, then its order on three divorces will continue.

Chief Justice and Justice Nazir in his minority judgment expressed the hope that the law of the Center will keep in mind the concerns related to Muslim organizations and Shariah law.

The judges present in the bench were from different religions. Among them were the Sikhs, Christian, Parsi, Hindu and Muslim religions. The bench reviewed seven petitions, in which five separate petitions were challenged by Muslim women challenging the practice of ‘Triple Talaq’ in the community.

The petitioners had claimed that the practice of ‘Triple Talaq’ is unconstitutional.

Muslim women who filed petitions challenged the practice of ‘Triple Talaq’, under which the husband speaks ‘divorced’ three times at a time to divorce. Many times he divorces himself on the phone or in a mobile message.

During the hearing, the apex court had said that the practice of ‘three divorces’ is ‘worst’ and it is not “the desired method” to break the marriage between Muslims. There are some parties, however, who call it ‘legal’.

Earlier, the Center had told the bench that if the ‘Triple Talaq’ is declared invalid and unconstitutional by the apex court, then it will bring a law to regulate marriage and divorces among Muslims.

In the Muslim community, the government had described the triple talaq in three parts Talaq-e-Bidhat, Talaq Hasan and Talaq e-Hasan as ‘one-sided’ and ‘non-negotiable’.

The government had said that every personal law should be in accordance with the constitution and the rights of marriage, divorce, property and succession should be kept in the same category and they should be in line with the Constitution.

The Center had said that “Triple Talaq” is neither the fundamental part of Islam nor is it the issue of ‘majority versus minority’. This is an “inter-communal conflict” between Muslim men and deprived women.

In the petition, ‘Nikah Halala’ and polygamy ‘Muslim marriage’ were also challenged.

The bench itself raised the main issue. It was written on the petition, “The quest for equality of Muslim women”.

The apex court automatically took the question of whether the Muslim women have to face gender discrimination in the event of divorce or other weddings of their husbands?

Aam Aadmi Party unlikely to take part in Election Commission’s EVM challenge

The Aam Aadmi Party (AAP), which has accused the Election Commission of “running away from a no-holds-barred hackathon”, is unlikely to take up the Commission’s challenge to demonstrate that its Electronic Voting Machines (EVMs) can be tampered with.

In a letter to the poll commission, AAP said it had promised a hackathon but with “rules and regulations”.

“Hackers are invited to test the security of any system, using any tools available. Such ethical hacking is to help understand loopholes so that they can be removed in the future,” it said.

It wondered why the EC — “an institution that has always protected democracy” — was not ready for an open hackathon to safeguard the country’s election process.

The letter, to Chief Election Commissioner Nasim Zaidi, was in response to EC’s rejection of AAP’s demand that it be allowed to “tamper” with the EVM motherboard at the challenge.

“Why is the Election Commission running away from no- holds barred hackathon,” it asked.

Following this, AAP is unlikely to participate in the EVM challenge on June 3, party sources said. The last date to participate in the exercise ends on Friday.

“You have said that tampering or replacing the motherboard of an EVM would mean that it is no longer the same device. (But) how would you know that the motherboards of the existing EC machines have not been replaced or tampered with,” the letter, written by AAP National Secretary Pankaj Gupta, asked.

It said if the EC was so confident that an EVM was tamper-proof, it should allow the machines to be hacked, without imposing any rules.

The EC said the EVM would lose its originality if changes were made to its internal circuitry and it would not be the EC’s EVM.

Earlier this month, AAP had “demonstrated” how EVMs could be manipulated in a special Delhi Legislative Assembly session. The EC had then said the demonstration to prove that the machines could be hacked was carried out on a “look alike” EVM and not on the one used by the commission.

“If the machines look the same, behave the same till some codes activate the changed programming, then how do you know whether any tampering has taken place on the machines in your possession,” Gupta asked.

The Bottle Recycling Machine enables the users to throw the plastic bottle in the machine which will recycle in for other uses to make clothes, grocery bags. After Churchgate, other stations like Mumbai Central, Dadar, Bandra (local), Bandra Terminus, Santacruz, Andheri, Goregaon, Borivali, and Bhayandar these machines will be installed.

The devices installed shows other options like donations, mobile recharge, discount coupons, etc. The Machine manufacturing company Wockhardt Foundations which is in talks with Reliance Jio, Dominos and McDonalds for coupon rewards and discount vouchers.

A group of farmers from Tamil Nadu stayed put at Jantar Mantar here for the seventeenth day in a row to demand drought relief package from the central government. Notably, the National Human Rights Commission had in January issued a notice to Tamil Nadu government over reported death of 106 farmers during a period of one month in the state and sought a detailed report from it in the matter.

The farmers belonging to Cauvery belt are protesting here demanding a drought relief package of INR 40,000 crore from the Centre, farm loan waiver and setting up of Cauvery Management Board.

Lending support the protesting farmers, chief of Naam Tamilar Katchi, a regional political party in Tamil Nadu, Seeman said it is only the farmers who do not have the right to fix a proper price for their produce in the market.

“Manufacturers of all goods set a price for their product, but farmers are not able to do so. The governments should immediately act for redressing their grievances,” Seeman said. The founder of Viduthalai Chiruthaigal Katchi, another regional political party, Thol Thirumavalavan is also expected make his presence in Jantar Mantar to offer his support to the farmers.

Meanwhile, students of Government College of Fine Arts in Chennai, who are on an industrial visit to the national capital, too offered their support to the farmers and drew paintings depicting their hardship. The NHRC had observed that there was a need for real implementation of the laws and policies made for the farming sector especially, the small farmers.

Reportedly, it has not rained, and the level of the ground water has also shrunk at many places in the state. The water bodies are also drying. The poor farmers, who depend on their crops, are the most vulnerable section of the society and they always become victims of various vagaries, the Commission had said.

Arvind Kejriwal Defamation case: Delhi High Court refuses stay on trial court proceedings

The Delhi High Court today refused to stay trial court proceedings in connection with an Arvind Kejriwal’s defamation case complaint filed against Chief Minister Arvind Kejriwal and Deputy Chief Minister Manish Sisodia. Justice I S Mehta, however, granted the exemption to the Aam Aadmi Party (AAP) leaders from personal appearance on April 6 before the trial court in the matter.

“Let the proceedings before the trial court goes on. I am giving relief that they (Kejriwal and Sisodia) are exempted from appearing in person before the trial court on April 6,” the court said. It said that the two will file an exemption application through their counsel before the trial court, which should be decided as per law.

The court’s direction was issued during a hearing of a petition filed by the two AAP leaders, who sought to quash of the criminal defamation complaint filed by advocate Surender Kumar Sharma. The two also sought a stay on the proceedings before the trial court, which is yet to frame an issue in the matter.

The leaders contended that the order of the trial court summoning them was “erroneous”. They also said that a false complaint has been filed against the chief minister and his deputy. The high court today issued a notice to complainant Sharma in the matter and asked him to file his response by July 28.

It also asked the Delhi police to file the status report in the matter. Besides Kejriwal and Sisodia, the complainant has also named Yogendra Yadav in his complaint. Yadav was a member of the National Executive of the AAP until 2015 when he was expelled for alleged anti-party activities.

Later, he floated his own party Swaraj India which is going to contest municipal corporations election in Delhi. Sharma had alleged that in 2013 he was approached by volunteers of AAP who had asked him to contest the Delhi Assembly elections on a party ticket, saying Kejriwal was pleased with his social services.

He filled up the application form to contest the polls after being told by Sisodia and Yadav that AAP’s Political Affairs Committee had decided to give him the ticket. However, it was later denied to him.

On October 14, 2013, the complainant claimed, articles in leading newspapers carried “defamatory, unlawful and derogatory words used by the accused persons” which have lowered his reputation in the Bar and the society. Opposing the complaint, the AAP leaders submitted that cancellation or allotment of an election ticket is the prerogative of the party.

“Party has asked him if any cases were pending against him to which Sharma had said nil. Later it was found that several cases were pending against him and he had concealed this information. “Kejriwal did not issue any press release against Sharma. The party had issued the press release. So no defamation case made out against Kejriwal,” the counsel for the two submitted.

On the basis of the complaint, the trial court had sought their presence before it in the matter. It, however, had granted bail to Kejriwal, Sisodia, and Yadav, after they had appeared before it in pursuance to summonses against them.

The summonses were issued on the complaint under sections 499, 500 (defamation) and 34 (common intention) of the IPC, with the trial court saying there was prima facie material to summon the accused.

While issuing summonses against AAP leaders, the trial court had said, “The press release published in newspapers, as well as testimonies of witnesses, reflect that defamatory remarks were published in the newspaper which affected the reputation of the complainant in the society and lowered his reputation in the eyes of other members of the society.”

Nigeria has called in the Indian envoy in the country to register its protest over an attack on four Nigerian students in Greater Noida and sought “diligent prosecution” against the Nigerians attacked in Greater Noida perpetrators. The Nigerian students were allegedly attacked by people during a candle-light march for a 17-year-old Indian boy, who died of suspected drug overdose last week in Greater Noida. The boy’s parents alleged that the foreigners had kidnapped him and given him drugs which led to his death.

Enikanolaiye said the call for the prosecution of culprits was necessary to serve as a deterrent to others, the report said on Thursday. “We want to see diligent prosecution so that it would serve as a deterrent to those who think they can take laws into their hands and harass students who are going about their studies. That is why we felt we should register our concern to you on this occasion, and to please ask your government to take effective measures that this does not occur again,” he said.

He said the Indian high commissioner was called in to register the Nigerian government’s concern over the incident. He expressed concern that the incident was not the first of its kind as Nigerians had been attacked in the past by Indians.

“It is therefore, a concern to us that Nigerian students in that place were harassed, beaten up and many of them were seriously injured. We think this should not have happened considering the excellent relationship between two of us the two countries have things in common and have been great friends,” it quoted Enikanolaye as saying.

External Affairs Minister Sushma Swaraj has said the government was taking immediate action and she had spoken to Uttar Pradesh Chief Minister Yogi Adityanath who has assured her of a fair and impartial investigation into the “unfortunate” incident.
